These terms are the agreement between you and Strategic Field Solutions LLC ("TailGateBid", "we", "us") for using TailGateBid: the website at tailgatebid.com, the app, and the business websites and customer pages it hosts.
By creating an account or using TailGateBid you agree to these terms. If you use it for a business, you agree on that business's behalf and confirm you are allowed to.
Your account
You must be at least 18 and use TailGateBid for a business, not for personal or household purposes.
Keep access to your sign-in email secure. You are responsible for what happens under your account and for the people you invite to your team, including what each of them is allowed to see and do.
Give us accurate information about you and your business, and keep it up to date.
Free trial and plans
New accounts start with a free trial. We do not ask for a card to start one.
Paid plans are not on sale yet. When they are, the price and what each plan includes will be shown before you choose one, and you will not be charged for anything you have not chosen.
Features marked "coming soon" are plans, not promises. Do not rely on them arriving by any date.
What you put into TailGateBid
Your customer lists, price book, quotes, invoices, photos, website text and everything else you or your team add remain yours.
You give us permission to store, copy, display and send that content only as needed to run TailGateBid for you: for example, to email a quote to your customer or to show a job photo on your website.
You are responsible for your content and for having the right to use it.
Your customers and your work
TailGateBid is a tool. The quotes you send, the work you do, the prices and taxes you charge and the invoices you issue are between you and your customer. We are not a party to those agreements and are not responsible for them.
You are responsible for holding the licences, permits and insurance your trade requires, and for charging and paying the right taxes. Tax amounts in TailGateBid are calculated from the rates you enter. They are not tax advice.
Only add a customer's contact details if you are allowed to contact them. Before sending a customer text messages, get their agreement and record it on their customer record. Stop when they ask you to.
When a customer approves a quote or a change order, TailGateBid records the name, the date and time and, where available, a signature and the network address it came from. Whether that record is enough for your purposes is for you to decide.
Your business website and reviews
You may publish a website for your business on a TailGateBid address. You are responsible for everything on it.
Only show a photo of a customer's property after that customer has agreed. Only show reviews that are genuine.
We may take down a website, or remove content, that breaks these terms or the law.
Payments from your customers
Today, TailGateBid lets you record payments you have received in other ways. It does not handle your customers' money.
If online card or bank payment is added, it will be provided through a payment company, and you will need to accept that company's terms to use it.
What you must not do
- Break the law, or help anyone else to.
- Send spam, or messages people have not agreed to receive.
- Upload anything you have no right to use, or anything unlawful, deceptive or abusive.
- Try to get into another business's data, or into parts of the service you were not given access to.
- Interfere with the service, overload it, or use automated tools to copy it.
- Resell TailGateBid or offer it to others as your own service.
Our part
We work to keep TailGateBid available, secure and backed up, but we do not promise it will never be interrupted or free of errors.
We may add, change or remove features. If we remove something you rely on, we will try to give you notice.
How we handle personal information is described in our Privacy Policy.
Ending or pausing an account
You can stop using TailGateBid at any time. Ask us and we will send you a copy of your business's data, close the account, or both.
We may pause or close an account that breaks these terms, puts the service or other people at risk, or (once paid plans exist) is not paid for. Where we reasonably can, we will tell you first and give you the chance to fix the problem.
Quotes and invoices you have already sent stay viewable by your customers while an account is paused.
No warranty
TailGateBid is provided "as is" and "as available". To the extent the law allows, we make no warranties, express or implied, including warranties of merchantability, fitness for a particular purpose and non-infringement.
Limit of our liability
To the extent the law allows, we are not liable for lost profits, lost revenue, lost data, or indirect, incidental, special or consequential damages.
Our total liability for any claim connected with TailGateBid is limited to the greater of the amount you paid us in the 12 months before the claim arose, or 100 US dollars.
Some places do not allow these limits, so some of them may not apply to you.
If someone makes a claim because of you
If someone else brings a claim against us because of your content, your website, your work for your customers or your breach of these terms, you will cover our reasonable costs and any amounts we have to pay.
Changes to these terms
We may update these terms. If a change is significant we will tell you by email or in the app at least 30 days before it takes effect. If you keep using TailGateBid after that, you accept the new terms.
Governing law
These terms are governed by the laws of the State of South Carolina, USA, without regard to its conflict-of-law rules. Disputes will be heard in the courts located there.
